1. Agreement
These Terms of Service ("Terms") form an agreement between you and Above AS ("we", "us", "our") and govern your use of the Peoplekeeper mobile application and any related websites or services (together, the "Service"). By downloading, installing, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
2. The Service
Peoplekeeper is a personal app that helps you remember details about the people in your life. The Service is provided "as is" and is intended for personal, non-commercial use.
3. Your content
Anything you create in Peoplekeeper — names, notes, tags, birthdays, and similar information — is your content. We don't claim any ownership of it, and we don't access it. You are solely responsible for the content you store in Peoplekeeper, including making sure you have the right to record information about other people under applicable laws.
4. Acceptable use
You agree not to:
- Use the Service in a way that violates any applicable law or regulation;
- Use Peoplekeeper to harass, threaten, dox, or harm any other person;
- Reverse engineer, decompile, or attempt to extract the source code of the app, except where this is permitted by law;
- Interfere with or disrupt the integrity, security, or performance of the Service.
5. App Store terms
Peoplekeeper is distributed through Apple's App Store. Your use of the app is also subject to Apple's standard App Store Terms and the Licensed Application End User License Agreement ("EULA"). In case of any conflict between these Terms and Apple's EULA for personal, non-commercial use of the app, the more restrictive terms shall apply.
You acknowledge that Apple is not responsible for the Service or its content and has no obligation to provide any support or maintenance for it.
6. Privacy
Your privacy matters. Please read our Privacy Policy to understand how Peoplekeeper handles (and doesn't collect) your data.
7. Intellectual property
The Service, including its design, code, artwork, name, and logo, is owned by Above AS and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the app on devices you own or control, solely for your personal use, in accordance with these Terms.
8. Updates and changes
We may release updates to the Service, change features, or discontinue parts of it at any time. Where reasonably possible, we will give notice in the app or on this site. We may also update these Terms; material changes will be reflected in the "Last updated" date above. Continued use of the Service after the changes means you accept the updated Terms.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that the Service will always be available, error-free, or that any defects will be corrected. Peoplekeeper is a memory aid, not a substitute for human relationships or professional advice.
10. Limitation of liability
To the maximum extent permitted by law, Above AS will not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of data, profits, or goodwill arising out of or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim — which, for a free app, will typically be zero.
11. Termination
You can stop using Peoplekeeper at any time by deleting the app from your devices. We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that may cause harm to us or others.
12. Governing law
These Terms are governed by the laws of Norway, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service that cannot be resolved informally shall be brought before the competent courts of Norway, unless mandatory consumer protection law in your country of residence provides otherwise.
